EAPPP’S OBSERVATIONS ON ANAC’S DISCIPLINARY MODEL

EAPPP, with the contribution of its Associates, has submitted its feedback regarding the tender disciplinary model for the award of services and supplies in ordinary sectors, with an amount higher than the Community’s threshold, adjudicated with the criterion of the most economically advantageous offer according to the best price/quality ratio, which the National Anticorruption Authority has put under consultation until 5 August 2017. 

Cocktail event for E.A.P.P.P.’s presentation

Next July 20th, E.A.P.P.P. will host a cocktail event of presentation in its headquarter in Milan – Piazza E. Duse, 1 from 7 p.m. until 9 p.m.
It will be the occasion to gather, also with some stakeholders, and discuss the next development of the Association’s research.

New publication of Sara Valaguzza and Annamaria La Chimia

Sara Valaguzza and Annamaria La Chimia’s article “A new approach to implementing the 2014 public procurement Directives in Italy: ANAC's soft law regulatory powers amidst uncertainty and need for clarity” published in the Public Procurement Law Review (PPLR), n. 4/2016, pp. 165-186. The article examines the reforms in Italy to modernise the public procurement market and implement the EU law framework of 2014, particularly the soft law regulatory powers that have been conferred on the National Anticorruption Authority (ANAC). Assesses the problems these measures are designed to address and the likelihood that the new ANAC powers will be effective, focusing on the controversies related to the definition of a “body governed by public law”.

UNECE and Portugal will create an International Center of Excellence on PPPs in water and sanitation sectors

As a consequence of the critical statistics concerning the sanitation services around the world, which are highlighting the necessity of infrastructure investments in water and sanitation, UNECE and Portugal have signed an agreement finalized to the institution of an International Center of Excellence on PPPs in water and sanitation, supported by the Ministry Of Environment of Portugal.

The amendment to the Public Procurement Code has been published on the Official Gazette

On the 13th of April 2017 the Council of Minister approved the final version of the legislative decree containing the dispositions that will integrate and rectify the current Public Procurement Code.
After a three-weeks wait, the decree has finally been published in the Official Gazette number 103 5/2017 with the number 56/17.
The dispositions therein contained will enter into force the 20th May 2017.
The main new points about the public-private partnership are concerning the project financing topic. Specifically, the Government has decided to raise the public contribution roof from 30% to 49%.

First detaining facility realized in project financing.

No later than summer 2018 a new detaining facility will open its gates in the southern part of Bolzano (Italy). This will be the first Italian penitentiary realized in public-private partnership in accordance with Article 43 of the Decree-Law No. 1 of January 24, 2012, converted into law with changes by Law No. 27 of March 24, 2012 which introduced the “project financing for the realization of penitentiary infrastructure”.

The first academic course on P.P.P. at the University of Milan has been completed

The first edition of the course entitled “Public and Private Partnership for Sustainable Development” taught by Prof. Sara Valaguzza has been completed during the II year of the L.L.M in Sustainable Development at the University of Milan, which involved of students from Iran, China, Brazil and Belarus, as well as Italy.
This is a first important step towards the spreading of the P.P.P. culture in Italy and in the World and for the formation of new generation of conscious professionals.
This course is planned also for the next academic year.

Convention between EAPPP and the University of Milan for stages and internships

Today, June 29th 2017, EAPPP has finalized a convention with the University of Milan to promote stages and internships for national and international students who want to deepen the juridical aspects of public-private partnership, under the guidance of EAPPP’s tutors.
The convention is the first step for the promotion of a comprehensive program, that could involve all the Universities associated to EAPPP and to develop program of study and projects of research on the themes of interest of the Association.

E.A.P.P.P. takes part in the Workshop on the adaptation to the Italian legal context of the FAC-1 Framework Alliance Contract

The University of Milan hosted the Workshop on the adaptation to the Italian legal context of the FAC-1 Framework Alliance Contract, an innovative multilateral contract, which can be used by both public and private subjects involved in the implementation of a cooperation, consistent with the execution of works, services and supplies and E.A.P.P.P. has actively participated to the works as an institutional stakeholder invited to provide its feedback.
Prof. David Mosey, Professor at King’s College London and Director of the Centre of Construction Law and Dispute Resolution participated at the Workshop together with several Founding Members of E.A.P.P.P.: Prof. Avv. Sara Valaguzza, President of the Association, Avv. Alessandra Canuti, Vice President, Prof. Angelo Ciribini and Prof. Giuseppe Di Giuda.

UNECE and NDCR together for a development program

UNECE and the National Development and Reform Commission of China are launching a PPP program that will involve several countries and will have the following goals: to implement the capacity building for courtiers with a people-first PPP; to start an international policy dialogue in order to create even levels in the field of public procurements.

Central Purchasing Body of “Val Trompia”: published in the EU Official Journal the invitation to tender for the construction in P.P.P. of the sports facility in Ospitaletto

On May, 10th 2017 the invitation to tender n. 2017/S 089-173778 for the design, the refurbishment and the management in P.P.P. of the sports centre in the Municipality of Ospitaletto (BS) has been published in the Official Journal of the European Union. The object of the tender encompasses the realization of a new swimming pool with solarium, the renovation of the Tennis Club House, the extraordinary maintenance of the locker rooms and the renovation of the soccer field, along with the management of the tennis court and of the swimming centre for 20 years. The value of the tender is of € 7.251.375,49 of which € 4.250.000 of works and € 90.000 of security charges.

Establishment of the European Association of Public-Private Partnership: the Board of Directors lays the foundation for the new lines of research

The Board of Directors convened in order to define the first lines of research on which the group will focus: concessions in the sector of big network and hospital infrastructures. The experiences of Italy, The Netherlands, Portugal and United Kingdom will be examined.
The results of the researches will be presented during the seminar, which will take place on October 9, 2017.
